"Booking Date": The date you placed the order for the rental of an item; the date will be included in your booking confirmation email and on your customer account.

"Buyer": The purchaser of second-hand clothing via Borrowed From

"Borrow": The loan of a product by us Borrowed From to a user/customer

"Borrow Now": Rent Now

"Content": Photographs, videos or any other information posted to Click Here or Borrowed From social media platforms

"Cookie Policy" Click Here

"Customer Responsibilities": You hereby represent and agree when submitting a rental booking that:

You agree to pay the full replacement value of the product provided by us, Borrowed From, and accept liability to pay the Product Retail Value of the item in circumstance of loss or damage to the product or products. If you do not agree to the value of the Product Retail Value, do not rent/borrow the product.

"Damage Terms and Conditions": Acceptance of Click Here A non-negotiable contract the customer must agree to in order to borrow any item. If the customer's order does not include this, the rental contract will be rejected and they will not receive the chosen item, an automatic refund will be sent.

"I agree to all Damage Charges": Automatically added to users basket when checking out, agreement to Click Here

"Item" The clothing & accessories owned & rented out by Borrowed From Limited

"Delivery Fee": The shipping cost for each transaction/order

"General Terms": The terms and conditions of use that apply to all website users.

"Listing": The listing of a product by us Borrowed From on the Platform

"Member(s)": Any person who has registered to have a Borrowed From Account

"Product": The clothing & accessories owned & rented out by Borrowed From Limited

"Rent, Rental & Renting": The rental of a product or multiple products by a customer via the Borrowed From Platform in consideration for the Rental Fee.

"Rental Period": the period of days a product or products is rented for

"Rental Start Date": The date at which the rental of a product or products starts. This includes bank holidays, weekends and public holidays, the date will be included in the customers booking confirmation email and available on your Borrowed From website account.

"Renter": A customer who is renting/borrowing a product on the Borrowed From Platform

"RP": Retail Price

"RRP": Recommended Retail Price

"Review": Conclusion of a Renter or Lender’s experience with Renting/Borrowing their chosen product via the Borrowed From Platform.

"Service": The borrowing, renting, lending, loaning, or sale of second-hand clothing by a customer via the Borrowed From Platform.

General Terms:

Intellectual Property

Unless otherwise stated, Borrowed From and/or its licensors own the intellectual property rights to all material on the Borrowed From Platform. All intellectual property rights are reserved. You can access this from the Borrowed From Platform for your own personal use, subject to the restrictions set forth in these terms and conditions.

You must not:

* Republish material from the Borrowed From Platform

* Sell, rent or sub-license material from The Borrowed From Platform

* Reproduce, duplicate or copy material from The Borrowed From Platform

* Redistribute content from The Borrowed From Platform

You acknowledge and accept that your use of the Borrowed From Platform does not confer on you any Intellectual Property Rights ones by Borrowed From and you hereby agree and undertake that you shall not attempt to register, or use, any trademarks that may imitate those owned by Borrowed From.

Rental Agreement

When making a Rental Order on Borrowed From you must agree to the Rental Agreement  as follows: A non-negotiable contract you must agree to in order to borrow any item. If you do not include this, the rental contract will be rejected and you will not receive the chosen item, an automatic refund will be sent.  No fee will be charged if the product or products are returned to Borrowed From in good condition with no damage, excluding those who have purchased Damage Protection, for which minor damage such as a broken zip or cleanable marks are covered up to the fee of £50. If Borrowed From determines, in its sole and absolute discretion, that damage has been caused to the product or products, the user will be charged up to the sum of the Replacement Value.

Failure To Return

If you do not post the item or items back on the last day of the Rental End Date, you acknowledge and agree that Borrowed From may charge you with any of the below fees:

£30 in late fees for each day after the Rental End Date that the item remains outstanding.`the applicable Rental Fee to the number of additional days you keep the item;

Any reasonable legal expenses incurred by Borrowed From in retrieving the item or outstanding Item Fees

All fees are payable in British Pound Sterling and are subject to change over time.

Failure to return the rental item(s) Borrowed From will contact the renter Borrowed From allowing 7 working days for the item(s) to be returned. If Borrowed From believes the item(s) will not be returned the full RRP of the item(s) listed on the item page will need to be paid by the renter. Failure to this a legal case will be opened.

If the return label was not used and an additional label was purchased and scanned the Renter must send the tracking details to hello@borrowedfrom.co.uk without this there is no evidence to show the item(s) was posted. If the return label was not used and no additional tracking details are sent to Borrowed From the Item(s) will be marked as not returned and additional costs will need to be paid by the Renter.

Shopify Payments and PayPal manages our secure payment, and you acknowledge and consent to sharing your information with both for the purpose of the Borrowed From Service. Shopify Payments or PayPal may require further identification checks, and you will be required to provide the further requested information to ensure your use of the Borrowed From Service.

Cancellation Policy

Please be cautious when making a purchase on Borrowed From; we do not offer refunds on any orders. If you have made a mistake or changed your mind on an order, we will offer you a studio credit equal to the value of your hire, which can be used on an alternate garment. Studio credits do not expire.

If you chose to no longer rent a product or products, you can cancel your booking up to 3 calendar days of the Rental Start Date. You will receive a full credit in the form of a code to redeem on any rental. Borrowed From does not offer refunds to the original payment method, unless it was a credit code used. This code will be valid for 12 months. Borrowed From reserves the right to charge you with a late Cancellation Change of £15

If Borrowed From believes that you rented a product or products with the intention of theft or to cause any other damage, we reserve the right to cancel the rental contract without notice and to charge you with a sum that we deem to be appropriate equal to that of the Replacement Value.

Users’ Liability

You are responsible for having sufficient funds available to replace lost or damaged products up to the sum of the Replacement Value of each product. The Replacement price is listed on each product under the RRP.

Personal Information

As a user of the Borrowed From Platform, you consent to our handling your personal data in accordance with the Privacy Policy.
